Further to your recent request to prepare a detailed medical report on behalf of your client, we set out terms and conditions for medico-legal work for your information and agreement. 

A cancellation fee will be charged for non-attendance reflective of the time lost where 24 hours prior notice is not received or the patient arrives too late to be seen.  The fee will be increased with each subsequent non-attendance to encourage prompt attendance. 

Reports and qualifying work and conferences with counsel will be based on an hourly rate of £250.00, including travelling and waiting, plus associated costs. 

Attendance at court as an expert witness will be charged at £2,500.00 per day. 

Travelling time in connection with attendances at court will be charged at an hourly rate of £150.00 in addition to travel and subsistence costs. 

If a conference or court appearance is cancelled or rescheduled, charges will apply* as follows:

  • With 7, 8 or 9 full working days notice given, prior to 9.00 am of the first date the expert is required to attend trial, 25% of attendance fee will be levied.
  • With 5 or 6 full working days notice given, prior to 9.00 am of the first date the expert is required to attend trial, 50% of attendance fee will be levied.
  • With 4 full working days notice given, prior to 9.00 am of the first date the expert is required to attend trial, 75% of attendance fee will be levied.
  • With less than 4 working days notice given, prior to 9.00 am of the first date the expert is required to attend trial, 100% of attendance fee will be levied. 

* Please note that notice must be given during working hours, Monday – Friday between 9:00 am – 17:00 pm.
Notice given at weekends and on bank holidays will be effective from 9 am the next working day.
VAT at the standard rate (currently 20%) will be applied to invoices, where applicable.

Please note that these fees will not be subject to assessment or taxation by the court and that all accounts are to be settled within the time specified on the invoice.  Payment terms are 90 days, unless otherwise agreed.  Payment made after 12 months from the date of the invoice will be subject to a 10% late payment fee.

  • These terms are subject to change.  We therefore suggest that you request a copy of our current terms on all future instructions.

We will keep medical records for 3 months from the date of the medical report after which time they will be destroyed without any further recourse to yourself.  If you wish the records to be destroyed earlier or returned to you please advise us.  Please note that there will be a charge for the return of records.
